Terms of Use
These terms are an agreement between you and Moving Tree Ltd (“we”, “us”), the publisher of the Tree Inspect app (the “app”). By downloading, installing or using the app you agree to these terms. If you do not agree, do not use the app.
Apple users: if you downloaded Tree Inspect from the Apple App Store, your use of the app is also governed by Apple’s Licensed Application End User License Agreement (Standard EULA). If these terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
1. The app
Tree Inspect is an offline field tool for collecting tree survey data. You design the survey form, record trees, attach photos, pin trees to maps you supply, and export files. The app does not require an account. Your records stay on your device unless you export or share them.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own work or your organisation’s work, while you comply with these terms and the rules of the store you downloaded it from. You may not copy, rent, sell or reverse engineer the app (except where the law allows), or use it to build a competing product.
3. Free version and Pro
The free version has limits. At the date of these terms they are: 6 projects, 6 templates, 10 custom fields, 8 options per dropdown or checklist, and no quoting. The free version shows adverts, including a banner and an advert before some exports.
Tree Inspect Pro removes these limits and adverts and unlocks quoting. Prices, product names and what Pro includes may change; the store page at the time you buy describes that purchase.
4. Subscriptions, free trials and purchases
Pro is available only as an auto-renewable subscription:
- a monthly auto-renewable subscription; or
- a 1-year auto-renewable subscription.
Either plan may include a free trial where one is offered. Subscriptions are bought through, and billed by, the Apple App Store or Google Play. Their payment, renewal and refund rules apply.
Auto-renewal
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase (or when any free trial ends).
- Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- The price and billing period are shown in the app before you confirm.
Free trials
- Where a free trial is offered, its length is shown before you subscribe. At the end of the trial the subscription starts and you are charged automatically unless you cancel at least 24 hours before the trial ends.
- Free trials are limited to one per eligible account, as decided by Apple or Google. Any unused part of a trial is forfeited when you buy a subscription.
Cancelling and managing
- iPhone / iPad: Settings › your name › Subscriptions, or the App Store account page.
- Android: Google Play Store › profile icon › Payments & subscriptions › Subscriptions.
- You can also tap “Manage subscription” in the app.
- Deleting the app does not cancel a subscription. Cancellation takes effect at the end of the current paid period, and you keep Pro until then.
Restoring a subscription
Your subscription belongs to the Apple ID or Google Play account that bought it. On a new or reset device, sign in to the same store account and tap “Restore purchases” in the app to reapply an active subscription. Restoring does not charge you again.
Refunds
Refunds are handled by Apple or Google under their own policies; we cannot refund store charges directly. Apple refunds can be requested at reportaproblem.apple.com; Google Play refunds through your Google Play account. Nothing in these terms affects your statutory rights as a consumer.
Offline grace period
If a subscription period ends while your device is offline, the app may keep Pro for a short grace period (currently 14 days) so that site work is not interrupted. After that, the free limits apply until the store confirms an active subscription.
5. Your records
You own the survey data, photos, maps and quotes you enter. You are responsible for having the right to use the maps, photos and client information you put into the app, and for handling any personal data lawfully.
You are responsible for backups. Uninstalling the app, clearing its storage or losing your device can delete records that have not been exported.
6. Not professional advice
Tree Inspect is a data-collection tool. It is not an arboricultural survey, a safety inspection, a planning report or professional advice. You are responsible for the inspections you carry out, the recommendations you record, the quotes you produce and how you use exported files. Always check the output before relying on it or sending it to a client.
7. Acceptable use
You must not use the app to break the law, store unlawful material, or interfere with the app or store billing. You must not present an export as an official certificate unless you are entitled to issue it.
8. Intellectual property
The app, its name, icon, built-in content and software belong to us. These terms do not transfer ownership to you. Your survey content remains yours.
9. Privacy
Our Privacy Policy explains what data the app uses, including advertising in the free version.
10. Changes and availability
The app is provided “as is”. Features, free limits and Pro inclusions may change, but we will not remove access you have already paid for during a paid period, except where the store ends the purchase or the law requires it. The app may be unavailable during updates or because of device, store or operating-system limits.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under the law of England and Wales. Subject to that, we are not liable for loss of survey data, lost fees, a rejected report, an incorrect quote, or any other business loss arising from use of the app.
12. Ending use
You may stop using the app at any time: uninstall it and cancel any subscription in your store account. We may stop offering the app or a feature; store rules decide what happens to any unused paid time.
13. Apple-specific terms
If you use the app on an Apple device: these terms are between you and us, not Apple; Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Law and contact
These terms are governed by the law of England and Wales. If you are a consumer, you may also bring a claim in the courts of the part of the United Kingdom where you live.
